Chairman Van Drew, Ranking Member Crockett, and members of the subcommittee, thank you for inviting me here today to discuss alien detention.
To address the issues raised by the committee, I have structured my written testimony to first explain the source of the immigration power in the United States and restrictions on state regulations of federal functions; second, to outline the criminal grounds of removal; third, to describe the laws governing immigration investigations, stops, and arrests; fourth, to examine on the reasons behind and the statutes governing detention under the Immigration and Nationality Act (INA); fifth, to explain the standards for due process in the removal process; sixth, to analyze so-called “sanctuary” policies and their impacts; and seventh, to address issues specific to the Delaney Hall ICE Detention Center.
